By accessing or otherwise using EcoTuesday.com, any information provided as part of the EcoTuesday.com services, or any related emails, newsletters or services (collectively, “EcoTuesday.com”, “we”, or “us”), or by clicking “Join EcoTuesday.com” during the registration process, you signify that you (“User”) have read, understand, and agree to be bound by the terms of this User Agreement (“Agreement”). EcoTuesday, Inc.’s owners, managers, directors, employees, representatives or anyone else associated with the company does not accept any responsibility or liability for and damages, injuries, losses, claims, expenses or grievances of any form arising through the use of the website and associated services. EcoTuesday, Inc. is not responsible in any way for any communications, actions or omissions of any other persons interacting with the EcoTuesday.com website.
We grant you a limited, revocable, nonexclusive, nontransferable right to access EcoTuesday.com to view information as it is intended to be used, exclusively under the terms of the Agreement.

EcoTuesday.com User DOs & DON’Ts
The EcoTuesday.com User Agreement includes but is not limited to the following requirements:

DO

• comply with all applicable laws and regulatory requirements;
• ensure that information you provide to EcoTuesday.com is accurate, current and complete;
• review this User Agreement in full;
• review the Privacy Policy in full;
• review and comply with notices, changes or updates sent by EcoTuesday.com;

DON’T

• duplicate, distribute, sell, or otherwise transfer or commercially exploit content of EcoTuesday.com and its users (excluding content posted by you) except as permitted in the User Agreement;
• include information in your profile which is confidential in nature;
• imply or state, directly or indirectly, that you are affiliated with or endorsed by EcoTuesday.com unless you have entered into a written agreement with EcoTuesday, Inc.;
• adapt, modify or create derivative works based on EcoTuesday.com or other users’ content, in whole or part;
• engage in any action that interferes with the performance of the EcoTuesday.com website and infrastructure;
• remove any copyright, trademark or other proprietary rights notices contained in or on EcoTuesday.com or other users’ content;
• use information obtained from EcoTuesday.com to harass, intimidate or harm another person;
• collect, use or transfer any information, including but not limited to personally identifiable information except as expressly permitted in the User Agreement or as the owner of such information may expressly permit;
• infringe or use the EcoTuesday.com brand, logos and/or trademarks with written authorization;
• upload, post, transmit, or otherwise make available content that, in the sole judgment of EcoTuesday.com, is objectionable or which restricts or inhibits any other person from using or enjoying EcoTuesday.com, or which may expose EcoTuesday.com or its users to any harm or liability of any type.

PROVISIONS:
1. Eligibility:
To register with, access, or otherwise use EcoTuesday.com, you must (a) be 18 years of age or older; (b) not maintain more than one EcoTuesday.com account at any given time; (c) not be a direct competitor of EcoTuesday.com; and (d) have full power and authority to enter into this Agreement. EcoTuesday.com Users who do not meet these eligibility requirements are unauthorized and in violation of these terms of use and may not access or otherwise use EcoTuesday.com.

2. Registration and Termination:
EcoTuesday.com reserves the right to decline a user account at any time. EcoTuesday.com reserves the right to terminate your membership, delete your profile and any content or information that you have posted at any time, for any or no reason, at its sole discretion. The terms of this Agreement shall survive any termination.

3. Terms:
The term of this agreement is ongoing.

4. Cost:
The cost to use this website is free unless otherwise stated by EcoTuesday.com. EcoTuesday.com reserves the right to change this pricing policy at any time.
If you purchase any services from EcoTuesday.com, you will pay all applicable fees as they become due including any and all related taxes. You will reimburse us for any and all interest on and collection costs for any overdue amounts.

5. Login and passwords:
All users are required to have a login and password to use EcoTuesday.com. As a user of this community it is your full responsibility to keep the password private at all times.

6. Personal information:
Any information you post or upload to EcoTuesday.com is available to be viewed by all users and non-users of the website. Please do not upload any personal information that you do not want the general public to know or see (in particular, do not upload address details, phone numbers, license plate numbers, email addresses and images of your living location).

7. Content:
You are fully responsible for your conduct and all material and content you post or upload to the EcoTuesday.com site. EcoTuesday.com is under no obligation to verify the identity of any Users of the site or to supervise content provided by Users.

Any content you provide to your profile page or upload anywhere on the website may be accessed, modified or amended by any EcoTuesday.com staff, owners or appointed representatives. EcoTuesday.com does not manually screen or filter content before it is uploaded to this website. We rely on users to report inappropriate content. You must not upload any information or material that defames any person or group of persons or is obscene, pornographic, indecent, harassing or otherwise inappropriate as determined by EcoTuesday.com at its sole discretion. Your content must also not include any malicious computer code, including but not limited to any viruses, trojan horses or any other computer programming code that may damage or interfere with the EcoTuesday.com website, any of the information on this website or affiliated websites, or the systems of site users.

EcoTuesday.com does not warrant that information that you upload to this website will be free from use, misuse, adaptation, appropriation or damage by any other users and non-users of this website. This includes but is not limited to observations and comments you may post as part of discussion threads or other online conversations. Users should therefore not upload, post, or otherwise share information that may be considered confidential by themselves or others.
Any information or material uploaded to this website by EcoTuesday.com directors, employees, sub editors, editors or other appointed representatives always remains the copyright of EcoTuesday.com at all times.

 
EcoTuesday.com does not take responsibility for the actions or authenticate the identity of all users of EcoTuesday.com. In turn we cannot prevent them from acting under false names or aliases. As part of this agreement you agree not to impersonate or act like any other person that you are not. We take no responsibility for the consequences of such action by any users of this website.

8. Copyright:
The content you upload must not infringe any copyright laws, trademarks, intellectual property laws or the rights of any person(s). The material that you upload to the website remains the copyright of the owner of that information or material at all times. You grant EcoTuesday.com a limited license to use, modify, publicly display, reproduce and distribute all content within the EcoTuesday.com and affiliated websites.

9. Behavior:
Users agree to act safely and fairly while using this website. Users agree not to harass, intimidate or harm any fellow users of EcoTuesday.com or any person(s) while using the services of EcoTuesday.com. Users agree to act in a responsible and civil manner.

10. Spam:
EcoTuesday.com does not tolerate spam messages sent to EcoTuesday.com or its users. If you spam, your account will be cancelled immediately without warning.

11. Illegal activity:
Users agree to not use this website for any pornographic or illegal purposes.

12. Newsletters:
Users agree to receive the twice-monthly EcoTuesday.com newsletter upon accepting this agreement. Users have the option to unsubscribe from this newsletter at any time through the unsubscribe links in the newsletter itself.

13. EcoTuesday.com events:
EcoTuesday.com does not take responsibility for any consequences that result from your attendance at our events. Participants are responsible for their own behavior and safety at all times. EcoTuesday.com does not take responsibility for any consequences of your interactions with other participants of these events.

14. Amendments:
The terms of this agreement can be changed at any time. You are bound to the changes of this agreement, and it is your responsibility to stay updated on such changes. You agree that you are bound to the changes of this agreement from the time you joined EcoTuesday.com and agreed to these terms.

15. Trademarks:
The names EcoTuesday and EcoTuesday.com and the EcoTuesday.com website address, logos, intellectual property, trademarks and design elements are the property of EcoTuesday, Inc., a business registered as an S Corporation in the State of California in the United States. The names and likenesses must not be used, altered, adapted, distributed, printed, displayed or used for any commercial or personal purpose that is not approved in writing by EcoTuesday.com, Inc.

16. Indemnity:
You agree to indemnify and hold EcoTuesday, Inc., our directors, employees and appointed representatives harmless from any and all claims, liabilities, damages, costs and losses, including reasonable attorneys’ fees, that arise directly or indirectly from your breach of any part of this agreement.

17. Privacy Policy:
Your privacy is important to us. Users of EcoTuesday.com should review and refer to our privacy policy, which forms part of this agreement.

18. Governing Law:
The terms of this agreement and any disputes with us or our Affiliates are governed by the laws of the state of California.

19. Arbitration:
All disputes and claims shall be resolved by final and binding arbitration under the rules and auspices of the American Arbitration Association, to be held in San Francisco, California, in English, with a written decision stating and legal reasoning issued by the arbitrator(s) at either party’s request, and with arbitration fees and reasonable attorneys’ fees of both parties to be borne by the party that ultimately loses.

20. Beta:
The current version of EcoTuesday.com is a beta version of the website. We may at anytime change or delete functions and design elements of the website or introduce new functions.
